These Terms of Service apply to the Hubway app and hubwaystudios.com, provided by Hubway Studios (“we”, “us” or “our”).

USING OUR SERVICES

Use Hubway and our website lawfully and in accordance with these terms. If you do not agree to these terms, do not use the services.

Hubway is independently and solo developed. It is not affiliated with, endorsed by or operated by the Public Transport Authority, Transperth or Transwa.

Using Hubway does not purchase a ticket, reserve transport or create a transport contract with an operator, i.e. Transperth.

TRANSPORT INFORMATION

Timetables, arrival predictions, vehicle positions, route information, fleet assignments and depot allocations may change or be incomplete, delayed or unavailable.

Live information reflects the information available from our sources. It does not guarantee that a vehicle will arrive at a particular time or follow a particular route.

Check official operator information, station displays and announcements when making travel decisions, particularly for disruptions and important connections.

MAPS AND PERSONAL SAFETY

Maps and walking directions may not reflect every access restriction, closure or local condition. Follow signs, applicable laws and your own judgement.

Use the app safely. Do not interact with it while driving or when doing so would distract you from your surroundings.

AVAILABILITY AND UPDATES

Hubway depends on your device, internet connection and external services. Features and data sources may change, and services may occasionally be unavailable during maintenance or because of circumstances outside our control.

We do not guarantee uninterrupted access or continued availability of a particular feature or data source.

Any future paid offering will disclose its price and applicable purchase terms before you buy.

ARTWORK AND INTELLECTUAL PROPERTY

All Hubway vehicle illustrations and wallpapers are original artwork and belong to Hubway.

You may use the app, website and artwork through their intended functionality. Reproducing, selling or commercially redistributing Hubway artwork requires permission unless otherwise permitted by law.

Third-party data and software remain subject to their applicable licences. These terms do not limit rights granted by those licences or applicable law.

ACCEPTABLE USE

You must not:

• Disrupt or damage our services.

• Attempt unauthorised access or bypass security controls.

• Misuse another person’s information.

• Use the services for unlawful purposes.

• Send automated requests that place an unreasonable load on our services.

We may restrict access where reasonably necessary to address abuse, security risks or unlawful activity.

External websites and services operate under their own terms and privacy policies. We do not control those services.

CONSUMER RIGHTS AND RESPONSIBILITY

Nothing in these terms excludes, restricts or modifies rights, consumer guarantees or remedies that cannot lawfully be excluded, including those under the Australian Consumer Law.

Subject to those rights, we do not guarantee the accuracy or completeness of every transport prediction, vehicle assignment or direction. Responsibility for any loss and the remedies available will be determined under applicable law.

CHANGES AND CONTACT

We may update these terms as our services change. The revision date appears above. Where appropriate, material changes will be communicated through the app or website.
